Kenya: Three Charged With Unlawful Procession Of Election Materials

Ibrahim Haji, Mohammed Kanyare and Nurdin Kanyare were arraigned on Monday at Milimani law courts for contravening section 3 of Election Offences Act 2016.

Haji allegedly prepared a Black Book with people’s names, identification particulars and phone numbers on February 11, and claimed it was a voters register.

He was also charged with having the book purported to be the register of voters in Mandera North constituency.

Mohammed and Nurdin were accused of aiding the preparation of the book at Maslat Guest House in Eastleigh, Starehe subcounty.

They were also accused of unlawfully procuring election materials – 33 filled and 50 blank form Ds used for the transfer of voters.

The trio allegedly prepared the forms without the authority of the Independent Election and Boundaries Commission.

 State counsel Jemmimah Aluda told the court they wanted the matter determined before the August 8 general election.

“We want the matter fast-tracked. We have evidence save for statements. All our witnesses are ready,” she said.

But lawyer Nicholas Sumba said the offences his clients were charged with were fueled by internal politics in Mandera North.

“This matter is a political contest between parties in Mandera and is not related to the the general election,” he told Chief resident magistrate Francis Andayi.

The three, who were arrested in Eastleigh on February 11, denied the charges and were freed on Sh500,000 bond or Sh200,000 cash bail.

The matter will be heard on February 23, March 13 and March 15.
