Former Commission for the Implementation of the Constitution (CIC) chairman, Charles Nyachae says he would have resigned if he was the chair of the Independent Electoral and Boundaries Commission (IEBC).
Nyachae said although he doesn’t necessarily share the reasons that the opposition has given for the removal of IEBC commissioners, the commission has failed and therefore the commissioners should voluntarily resign.
“Today if I was the chair of IEBC as a matter of professional integrity, as a matter of good conscience, as a matter of honour I would resign. This is because there are mistakes that IEBC has made that I think would justify that as a natural next step,” Nyachae said in an interview in Nairobi on Monday.
He said the current push for the removal of IEBC commissioners was brought about by the referendum saga.
“What has immediately precipitated the problem we are having today is the whole referendum saga. IEBC handled the referendum saga long before CORD took their signatures in a manner that the process was bound to fail.
“As CIC before we left office we had tried to engage IEBC and even advised them not to even think of having a referendum without a referendum law. By not doing that I think they set the stage for the disaster we are facing today,” Nyachae said.
CORD is demanding for the disbandment of the IEBC saying it lacks credibility and cannot be trusted to conduct the 2017 polls.
Their calls have been backed by the National Council of Churches in Kenya, the Central Organization of Trade Unions, the Commission on Administrative Justice and the Law Society of Kenya.
