Governor Obtains Orders Barring EACC From Charging Him

Murang’a Governor Mwangi Wa Iria can smile after Nyeri High Court stopped the Ethics and Anti-Corruption Commission (EACC) and Director of Public Prosecution (DPP) from arresting and prosecuting him.

Wa Iria obtained an order from Judge Jairus Ngaah that quashed his prosecution.

Through lawyer Mbugua Ng’ang’a, the Governor submitted that he was arrested at Agha Khan Hospital by EACC officers who forcefully bundled him into a vehicle and drove him to Integrity Center.

Wa Iria said that EACC detectives carried out an illegal raid on his house in what he termed as “uncouth, inhuman and oppressive manner”.

He claimed that the officers confiscated his cell phone and personal documents and that he suffered soft tissue injuries after being manhandled by the officers but he later sought for treatment and discharged.

In his application, he added that he reported the assault to Kirwara police station and obtained a P3 form filled by a medical officer.

“The oppressive, inhuman and degrading manner in which they carried out the illegal raid at my private residence and subsequent arrests clearly points to malice, ulterior motive and unjustified use of power to settle scores,” the application stated.

Barely two months ago, a High Court upheld the Governor’s application against EACC and DPP and quashed a decision to prosecute him for allegedly swearing a false declaration.

In the application, wa Iria had named EACC, DPP, Makadara Law Court Chief Magistrate and the Attorney General as respondents respectively.

The case will be heard on March 29, this year.
