Tyrese Gibson, an American actor and musician, is reportedly demanding a new judge in his divorce case with ex-wife Samantha Lee, claiming Superior Court Judge Kevin M. Farmer is prejudiced against him.
The Fast & Furious star, 44 made the request in documents obtained by DailyMail.
The actor added that he disagreed with Farmer’s handling of the case, and that the judge abruptly postponed a court hearing and ordered him to pay a $450,000 bond ‘within 10 days in connection with his appeal of an order in the case.’
Gibson believes he intended to explain why he couldn’t make the payment due to the Hollywood strikes impacting his income during that session.
Tyrese, who had requested to have Farmer removed from his case last year, claimed that the hearing was canceled only a few days before it was scheduled.
Gibson’s lawyers also released a lengthy statement with bombshell accusations against the judge and the lawyers of his ex.
They wrote: ‘This latest injustice by Judge Farmer is just one of many actions which suggests that there may be something else is going on at the Fulton County Superior Court Judge. Is there collusion going on with Judge Farmer and Samantha Gibson’s lawyers, or does Judge Farmer regularly deny litigants the opportunity to be heard?’
They also called into question the judge’s ability to remain fair and balance.
Gibson’s attorney continued: ‘Judges are supposed to use their authority and discretion to make fair and impartial decisions in the cases in which they are assigned. They are supposed utilize the authority that they have to carefully evaluate the testimony of the witnesses and the evidence presented.
‘Judges have to be patient and allow parties to have their days in court. Judges are supposed to allow every person the opportunity to be heard – to present all of their information, evidence, and testimony that they have so that the judge can use his discretion to make a fair decision..’
Last year, the judge scolded Tyrese during his testimony when the actor and singer reportedly back-talked to Farmer.
At the time, Samantha’s attorney noted that Gibson had amassed over $2 million in 2018 despite him claiming to have been in financial ruin at the time.
‘I don’t do the CFO thing. Here’s a question to you, smart person,’ Tyrese back talked, according to TMZ.
However, he was cut off by the judge, who yelled at him, ‘You don’t ask questions! That’s not how this works!’ The judge also allegedly threatened to hold the singer in contempt should he misbehave again.
Farmer also ordered the star to pay $10,690 in child support to his ex – whom he shares daughter Soraya with.
‘This is not a punishment for you. Put that money where it belongs, in the child!,’ the judge said while announcing the child support amount.
He also advised both parents to not bad mouth each other in front of their daughter.
Tyrese owes his ex a total of $209,000 in child support, which was retroactive to when Samantha filed for divorce in September 2020.
Because Tyrese has been making payments on Samantha’s car for two years, the judge decreased the amount by $46,000, lowering the lump sum to $169,000.
Tyrese also became formally single during a procedure in Fulton County, Georgia, when the judge accepted his estranged wife’s petition for divorce, according to the site. He was also not compelled to pay Samantha spousal support.
Tyrese and Samantha announced their split and divorce in December 2020, three years after secretly marrying.
At the time, Gibson took to Instagram to release a statement that read, ‘After much thought, consideration, and prayer, We unfortunately have made the difficult decision to officially separate & divorce.’
‘Our intention is to remain the best of friends & strong coparents,’ he penned, later adding, ‘Our journey together has been a ride of both ups & downs, but it’s a journey that neither of us would have chosen to take with anyone else.’
In conclusion, he wrote, ‘We would really appreciate your most sincere prayers and to respect our privacy at this time as we deal with the reality of where we are.’
