A Narok blogger, who was arrested on Saturday by CID officers for allegedly posting offensive message against Interior Cabinet Secretary Joseph Nkaissery, appeared before a Narok court.
Chief Magistrate Wilbroda Juma ordered the CID officers to release a 28 year-old Jackson Saruni Tirkolo on police bond after she opposed plea by prosecution to have him detained for five more days.
Juma said that the evidence presented to court does not warrant him to be held for more days for the investigations to be completed.
Tirkolo works with Good Hope Sacco in Narok town.
In sworn affidavit by Police constable Samuel Kagege, accused Tirkolo of propagating hate speech contrary to section 13(1)(a) of the National Cohesion and Integration of the constitution.
Kagege said that the suspect posted abusive, insulting and threatening words on May 7 this month in an “Elelero e Maa” facebook group page.
“The prosecution request for a pre-trial detention for police to record a statements from CS Nkaissery, and have his phone be subjected the phone to forensic audit was not enough to have him continue to stay in police custody since the officers can do it while he is out on bond,” said Ms Juma.
His lawyer Martin ole Kamwaro said that his detention is a breach of his constitutional rights of the accused person for police to continue holding him since he has right to be given bond.

Prosecutor David Mwangi said the police sort the permission from to hold Tikolo since he can interfere with the investigation.
