The charges against Dieter Bergs, who will turn 80 on Sunday, were withdrawn in the Johannesburg Magistrate’s Court on Monday for the murder of Genee Bergs, 70, in their Parktown North home in March last year.
He told the police at the time that he was in his study, and his wife was asleep, when he heard two loud bangs.
When he went to see what happened he saw an intruder, who then shot him in the hip.
He was granted R10 000 bail in September 2014,News24 reported.
