The trial of Ndaedzo Isaac Vele, Tshepo Leon Mosai, and Simon Nthone Msibi was postponed in August for legal argument on Mosai’s claim that he had not had a fair trial.
The trial had been delayed by determinations over statements the accused allegedly made to police, and allegations that they were assaulted after their arrest.
The three have pleaded not guilty to charges of murder, or alternatively conspiracy to commit murder, robbery, and kidnapping.
Vele was a member of the SA National Defence Force and Msibi a police officer.
The State alleges Maswanganyi was killed because of unhappiness with how he conducted certain investigations.
Vele and Mosai were allegedly approached to help with Maswanganyi’s murder. They are believed to have approached Msibi and two other men and pointed the general out to them.
On June 17, 2013, the group apparently forced Maswanganyi’s Isuzu bakkie off the road in Hammanskraal and forced him into another car at gunpoint.
They allegedly assaulted and strangled him before dumping his body in the veld. He was found with his hands and feet bound.
Maswanganyi’s wife Shereen died in a car accident on her way to the court in July.
