On Tuesday the matter was postponed to October 16, when magistrate Sharlotte Sithole is expected to rule on whether bail should be granted.
Borislov, Krejcir, Siboniso Miya, Siphiwe Memela and Nkanyiso Mafunda are to stand trial for the murder of Sam Issa in Bedfordview in 2013.
Issa died in a hail of bullets at an intersection in Bedfordview.
The State handed in an affidavit by MiroslavPotiska on Tuesday. The Czech national used to work for Krejcir in SA between 2010 and 2012.
Potiska’s statement was taken by the investigating officer in the case, Captain Bongani Gininda, in Prague last week.
In the statement Potiska claimed he left SA when he realised Krejcir was involved in criminal dealings.
He claimed Krejcir “killed anyone who crossed him”.
Annelene van den Heever, for Krejcir, said she would not object to the statement being entered as evidence, but said that for the statement to be admissible it should have been taken at the SA consulate.
She claimed Gininda failed to seek clarity on important allegations made against Potiska, including that Krejcir sent him back to Prague because of his drug use.
“There are unchallenged facts in this matter,” Van den Heever said.
While Krejcir faces a string of other charges and has already been convicted in a kidnapping and attempted murder case, Van den Heever asked Sithole not hold this against him.
“Is it in the interest of justice that you keep a person in custody because he has a bad reputation or has other matters pending?” she asked the court.
If Krejcir was to be granted bail in this matter, he would most likely not be freed due to the conviction he recently received in the High Court in Johannesburg.
That court will hear sentencing arguments on October 12 in that matter against Krejcir and five co-accused.
On the same day the Palm Ridge Magistrate’s Court is expected to hear another case against Krejcir and several others.
The case involves the murder of debt collector Phumlani Ncube, who was gunned down last year, and the attempted murder of Colonel Nkosana Ximba and investigator Paul O’Sullivan.
The two men had been investigating Krejcir.
The Czech fugitive has been behind bars since November 2012.
