Office of Director of Public Prosecution has blamed Independent Electoral and Boundaries Commission (IEBC) for delay to charge an MCA and one of its registration clerk allegedly found transferring voters in Laikipia last week.
Assistant DPP Central region, Job Kaigai Kurundu said he could not explain why the electoral body decided to by- pass his office and instead took the file straight to court.
“A file of such magnitude should have been forwarded to the DPP Office before the matter was rushed to court. IEBC applied its own mechanism of investigations and prosecutions,” Karundu stated.
Karundu refuted claims his office was dally dallying in the prosecuting Tigithi ward MCA Beth Muchiri and an IEBC clerk on claims of transferring voters from Nyeri to Laikipia counties.
The case which has attracted a lot of public and political interest has for the last two days failed to take off at Nyeri law courts owing to delay and confusion over the fate of the file.
Kurundu told the press he was yet to receive the charge sheet, neither had he seen the file said to be with police and the IEBC officials.
“Am expecting to receive the file before the end of the day, police county commander Eunice Kihiko has assured me of that, DPP office should have dealt and perused the file before it was taken to court,” he stated.
He said his office was still in dilemma as to what offenses the two were being charged with, adding that the matter had taken a political dimension.
A Section of residents from Laikipia had earlier written to DPP office, accusing it of delaying and withholding the prosecution file of the two and 11 others nabbed by police.
