Christine Baumgartner, Kevin Costner’s former wife, claims he has been ‘withholding’ his financial documents during their ongoing divorce.
Baumgartner, 49, who filed for divorce from the Yellowstone star on May 1 after 18 years of marriage, claimed in legal filings filed in California Superior Court Monday that the Academy Award-winning actor, 68, suppressed documents in the case, People reported Wednesday after studying legal documents.
Baumgartner has requested documentation about ‘his future activities and projected income’ in projects such as his upcoming film series Horizon.
Baumgartner, a handbag designer who shares three children with Costner – Cayden, 16, Hayes, 14, and Grace, 13 – asked the court to order Costner to provide the sought records.
Baumgartner’s legal team claims Costner has been’stonewalling’ them in disclosing relevant information, despite a child support court scheduled for next week and a prenuptial agreement hearing scheduled for November.
Baumgartner, who was given $129,755 per month in child support by the court in July, has stated that she felt pressured to sign the prenup, which provides her with a $1.5 million payout if the marriage ends.
Costner ‘has requested a multi-day evidentiary hearing on [Baumgartner’s] motion for child support, at which time the Court will review information about [Costner’s] gross cash flow available for support and projected future income,’ according to legal documents.
According to the attorneys, the court ‘will need to acquire evidence about those situations in order to make its determination,’ but Baumgartner ‘will be unable to introduce any material that [Costner] has chosen to keep from discovery.’
Baumgartner first wanted $248,000 in monthly child support, which Costner objected to in June.
The actor, who made around $20 million in 2022, said the amount was not feasible as he’s slated to make ‘substantially less’ since he has stepped away from the series Yellowstone.
Baumgartner’s legal team asked for information detailing Horizon – noting that ‘such documents evidence his future endeavors and anticipated income’ – and said Costner’s team has withheld them.
Baumgartner’s legal team cited materials they said depicted Costner’s lawyers resisting a request to turn over the documents detailing his potential earnings with Horizon.
A lawyer for the Bull Durham actor said the request ‘seeks documents that are not relevant given the parties entered into’ a prenup that stipulated ‘a limitation on spousal support and providing that all income earned during marriage would be the separate property of the spouse earning the income and providing for no community property.’
Costner’s lawyer described some of the requests as ‘burdensome, oppressive and harassing.’
Baumgartner’s legal team said that Costner’s team did submit some of the materials requested, but stopped short providing any details about Horizon.
Costner’s lawyer told the court on August 18 that ‘these documents have no bearing on Christine’s request for child support and her ability to calculate Kevin’s gross cash flow available for child support.’
Baumgartner has also asked for $9,000 in legal fees she’s racked up amid the specific part of the divorce in which she’s sought the documents from Costner regarding Horizon.
